Leisure World is facing a test of its “Governance Legitimacy.” It is unlike any faced previously within this Community. It’s not just over a proposed new Administration Building, though that looms large. Or that the Leisure World Community is bitterly divided over this seemingly, needless waste of money. Or that the Leisure World Board will renew, again, the contract of a General Manager, who by any objective assessment is an incompetent. No!

The dilemma, which this illegitimate LWCC Board does not grasp, is that many of the LW Residents, who have lived under this undemocratic governance system, have been working diligently from within the Community to bring about needed change.

Why was a legal matter pertaining to Leisure World, occurring over the last year, not covered as a story in any issue of the Leisure World News? What legal matter? what was the story?


THE TYPE OF STORY THAT WOULD WARRANT PAGE 1 COVERAGE SIMILAR TO THAT SEEN IN THE SEPTEMBER 6, 2018, ISSUE OF THE LW NEWS ABOUT ANOTHER LEGAL MATTER INVOLVING LEISURE WORLD.


The event not covered involved a former, twice Chairperson of the Leisure World Community Corporation (LWCC), current Board member, and current head of the Leisure World Foundation suing the LWCC over a claim of “Negligence.” That would appear to be newsworthy.

What were the specifics for alleging the claim of LW negligence? The lawsuit was filed in Montgomery County Circuit Court. The plaintiff, the LWCC Board Member, from the ‘filing information’, was represented by 2 attorneys.

Was Leisure World represented by legal counsel? Did Leisure World pay its $25,000. insurance deductible to be legally represented? Also, during the time the lawsuit was active, did the plaintiff, serving in the capacity of LW Board member matter, cast votes on matters, directly or indirectly, associated with matters addressed or pertaining to the lawsuit?

The public record shows the case being dismissed with prejudice in the Spring of this year. Was there a monetary settlement? Who paid for court costs? Did the LW executive committee request that management track staff time and out-of- pocket expense associated with defending LWCC in the case. Were LWCC’s costs recoverable?

The Residents of Leisure World are entitled to be informed about this matter.
